Reviewing and Drafting Interconnection Guidelines
Interconnection Guidelines provide a summary of the regulator’s interpretation of interconnection requirements under telecommunications legislation. They offer guidance on who will be entitled to interconnection rights and affected by interconnection obligations, and establish rules for making interconnection agreements. Areas likely to be covered in Interconnection Guidelines may include:
- Interconnection principles (national and regulatory policy issues, alignment with EU and WTO requirements as appropriate);
- Networks and services subject to interconnection rights and obligations(fixed, mobile and NGN);
- Establishing regulatory guidance in interconnection negotiations;
- Dispute resolution;
- Forms and contents of interconnection agreements (including contract provisions, technical terms and standards, conditions, procedures and requirements);
- Infrastructure sharing and collocation;
- Charges and charging structures (including unbundling of service elements);
- Confidentiality and regulatory reporting requirements;
- Measures to prevent discriminatory or anti-competitive behaviour;
- Defining and designating Significant Market Power (SMP).
InterConnect Communications has considerable experience in the design and implementation of interconnection regimes, and has assisted a variety of regulators worldwide in the drawing-up of suitable Interconnection Guidelines. Our work in this field includes:
- Reviewing existing interconnection arrangements and producing guidelines to assist with the effective operation of the interconnection regime in an Arab States country, supported by an industry-wide consultation process. InterConnect also helped to implement the guidelines by establishing working groups composed of representatives from the various operators, each group was assigned to oversee the drafting of specific aspects of the Reference Interconnection Offers;
- Drafting a full draft set of interconnection rules covering issues relating to the interconnection of public telecommunications networks in a Central European country and the provision of public telecommunications services by authorised operators and service providers;
- Assisting a national regulatory authority in the Middle East with the design and drafting of interconnection guidelines as part of the creation of a new, best-practice regulatory regime.
We can also assist with the drafting of operator-specific interconnection guidelines in cases where a network operator is not formally required to produce an approved Reference Interconnection Offer (RIO) but still wishes to define some standard parameters as a basis for interconnection negotiations.
